Protecting your privacy is of special importance to us; that being said, we exclusively process your data in conformity with the applicable law (GDPR, Austrian Telecommunications Act 2003). The following privacy policy statement informs you about the most relevant aspects of data processing within the scope of our Website.


1. Name and address of the entity responsible for processing data

2. Collection of personal data

Upon visiting our website, we merely store access data via so-called server-log files; these are data your browser automatically provides, without any specific reference to individuals, that is:

•    Type/version of browser
•    Language setting of browser
•    Operating system in place
•    Referrer-URL (previously visited page)
•    Host name of the accessing computer (IP-Address)
•    Time and date of server query

These data cannot be traced to any specific individuals; furthermore, the data are not combined with other data sources; besides, these data are deleted after a statistical analysis. To this end, user traffic on our website is stored in server log files. These log files are held by the web server provider for a maximum of 9 weeks. We have no way of tracing these data to any specific individual while using them.

Some functional features on our website ask the user to state personal data such as name, e-mail address, name and other data may be provided voluntarily here.

We process your data on servers located in Germany, hence within the purview of the EU Data Protection framework; however, we would also like to call your attention to potential exemptions set forth in points 6 to 10 of the present Privacy Policy statement (“Google Analytics“, “Mapbox“, “OpenStreetMap“, “Google Font”, “Youtube“) if third-party providers employ tools with their servers located abroad.

3. Data Collection

If you grant your consent to collecting data, we will collect and process the following personal data, in addition to the data specified above.

salutation, first name, last name, street, zip code, city, country, phone, e-mail

b) registration experts
salutation, first name, last name, phone, e-mail, company name and address, business field

When you complete our online contact forms, we use this information to contact you regarding your interest. This data is stored and used exclusively for the registration or for the contact and the associated technical administration.

If you granted your consent to using personal data for special purposes subject to the reservation of consent, you can revoke this authorization at any time. The data will be deleted from us. Data which you have entered during the online contact request will be forwarded to AIR-COND distribution partners for the purpose of processing your inquiries. You are entitled to restrict your consent to the use of your data. The data will be deleted within the scope of the restriction.

 

3.1 Purpose of Data Collection

We use your personal data for the following purposes: to render services you requested, particularly to receive your inquiry and/or registration and attend to them.

3.2 Newsletter

You have the option of subscribing to our newsletter on our website. With this newsletter we inform you at regular intervals about products, innovations, offers/actions, competitions, etc. In order to receive our newsletter, you need a valid e-mail address. When you register for our newsletter, we will save your IP address and the date and time of your registration. This serves to protect us in the event that a third party misuses your e-mail address and subscribes to our newsletter without your knowledge. We do not collect any further data. The data collected in this way is used exclusively for subscribing to our newsletter. A transfer to third parties does not take place. A comparison of the data collected in this way with data that may be collected by other components of our site does not take place either.

You can cancel your subscription to the newsletter at any time. After you have unsubscribed, we will no longer use your data for sending the newsletter. If we have no business relationship with you and we are therefore subject to statutory retention requirements, your data will be deleted after you unsubscribe from the newsletter.

4. Data Processing on behalf

Based on a separate agreement concerning the processing of personal data on behalf your data (as set forth in point 2) will be collected, processed and used by our web host within the purview of processing data on behalf as set forth in Art 28 GDPR in conformity with the respective applicable provisions; access data are exclusively stored on servers located in Germany; however, this does not imply a transfer of your data to a third party in terms of data protection; it is AIR-COND that is accountable to you in terms of data protection.

5. Rights of individuals concerned

a) The right to withdraw consent
You have the right to withdraw or revoke your consent to storing your personal data at any time; as well, you have the right to revoke, at any time, the consent to collecting and storing any additional data you provided voluntarily. We would like to point out that we check your identity for the purpose of protecting your privacy and security before you may adopt any such measures. If you want to withdraw your consent as to the future use of your data and/or wish to revoke your consent granted, you want to turn to the following address, ideally by supplying a copy of your ID: doris.strohmeier@air-cond.com; in the event you revoke your consent to storing, processing, and using your personal data, we will immediately erase and block access to them.

b) Erasure, deletion (“the right to be forgotten“), and rectification of your personal Data
You also have the right to restrict the processing of your personal data we have stored, to withdraw consent, to have access blocked to them, to have them erased and to have them rectified, respectively; in addition, you also have the right to get your data transferred to other parties.

c) The right to obtain information
You may request to obtain information from us whether and to what extent we process your data.

d) The Right to lodge a complaint
In case you think that we are violating Austrian or European Data Protection Law while processing your data, we may ask you to contact us in order to clear up any pending issues; it goes without saying that you also have the right to lodge a complaint with the Austrian Data Protection Authority, and a Supervisory Authority within the EU, as of May 25, 2018, as well.

6. Privacy as to the use of Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google uses cookies. The information generated by the cookie about the use of the online offer by the users are usually transmitted to a Google server in the USA and stored there. Google will use this information on our behalf to evaluate the use of our online offering by users, to compile reports on the activities within this online offering and to provide us with other services related to the use of this online offer and internet usage. In this case, pseudonymous usage profiles of the users can be created from the processed data. We only use Google Analytics with activated IP anonymization. This means that the IP address of the users will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases the full IP address will be sent to a Google server in the US and shortened there. The IP address submitted by the user's browser will not be merged with other data provided by Google. 7. Privacy as to the use of OpenStreetMap

This website uses uses the Open-Source-Mapping-Tool “OpenStreetMap“ (OSM) map service via an API. It is operated by the OpenStreetMap Foundation. To use “OpenStreetMap“ (OSM), it is necessary to save your IP address. This information is generally transmitted to an “OpenStreetMap“ (OSM) server and stored there. The provider of this site has no influence on this data transfer. The use of “OpenStreetMap“ (OSM) is in the interest of making our website appealing and to facilitate the location of places specified by us on the website.

8. Privacy as to the use of Mapbox

This website uses Mapbox Tiles to display interactive maps on some subpages. The Mapbox Tiles API is a map service of Mapbox Inc. (Mapbox). By using the Mapbox Tiles API, information about the use of this website, including your IP address, may be transmitted to Mapbox in the United States. When you visit a page that contains Mapbox Tiles maps, your browser establishes a direct connection to the Mapbox servers. Mapbox will send the map content directly to your browser and integrate it into the website. Therefore, we have no control over the amount of data collected by Mapbox in this way. 11. Privacy and Cookies

Our site uses cookies; small text files that enable specific, customized information on the user´s terminal while using the website; in particular, cookies lend themselves to determining the number of clicks and number of users of the pages, analyzing behavioral aspects of using the pages, and customizing our offerings; cookies remain stored until after the end of a browser session and may be reactivated while visiting the site again; If you do not wish to do so you may always change the browser setting so as to block or disable cookies altogether.

12. Data Retention

Personal data are stored over the course of the period pursuant to the applicable retention law; the respective data are subsequently routinely deleted so long as they are no longer required for the purpose of fulfilling or initiating a contract. In any event, pursuant to the Austrian Civil Code, data must be kept for up to 30 years in order to fend off legal claims within the purview of liability for damages or unjust enrichment.

AIR-COND reserves the right to amend, at any time, the current provisions according to the business requirements, if need be.
